Enviro stoves - My implicit/ explicit permitting issue

Got two Maxx-m's I installed in a Tae Kwon Do studio. Heating about 5500 sqft perfectly. Inspectors came in on other building code issues, reexamined the permitting and discovered that Enviro lists the units as "residential" space heaters. They highlighted everywhere in the manual the word appeared. Wanted Enviro to write a letter saying this application was ok, Enviro declined to go on record saying anything and that the listing should be speak for itself and if the AHJ wanted to permit the use it was their call.

Reading through Harmans manual for the P68, there is no implicit or explicit mention either way. Yet, both stoves are tested to the same standard. Haven't got the final word but I'm of the impression that the AHJ is going to make me pull the units.

Unfortunately, due to a hiccup, nobody ever called for final inspection of the work last winter, so it seems I'm fighting this from under a rock now. Aye aye aye...

FYI, though it is NOT mentioned anywhere in the warranty printed in the owners manuals, but is printed on Enviros website (the official list of warranty inclusions and exclusions...Enviros warranty is void if the unit is installed in a commercial building.!

Wtf?

So.....all of the units we dealers all have in our showrooms are void of warranty?

I'm not sure if the exclusion of rating a stove as residential makes it commercially rated either. You might want to ask that question next before you make another $8000 mistake.
 
What would happen if the P68s were installed I wonder??

Yes, i was looking as well but didn't find out a whole lot, LOL.
 
Might want to ask the inspectors what their concern is specifically? If the insurance company is comfortable with the heating source and it's installation ...

Edit: Wouldn't other heating appliances that would be applicable to the space also fall under residential use too? Did the owner tick them off so they're just throwing everything into the pile...
Is this a separate building with no other users?

Are there no restaurants in town with fireplaces inserts or pellet appliances? I guess they should close down all hearth stores with operable pellet stoves?

Scot, might want to have an HVAC engineer take a look at it ... possibly cheaper than other alternatives. Might have to put in an air exchanger if that is the concern. How old is the building? Is there a sprinkler system? Assembly occupancy so they will be more careful....

Edit: Wait ... If they gave you a permit for installation last year ... why wasn't installation stopped then? They can be ticked off for no follow-up inspection on installation but they should have refused installation before allowing a permit to be taken out in the first place.
