Long story short, propane company gouged my rates, so I told them to come pick up their tank and I switched to alternative heating source. They said it may be up to a month before they can get their tank. It has been sitting next to my driveway for almost a month now. How long before I can load that damn thing up and scrap it?

I'd be patient. It's their property, period and the lease agreement probably spells out the details. If it goes over 2 months maybe send them a bill for renting the space on your property instead?

Feeling the Heat
Gas companies put priorities on the service calls. Picking up tanks is way down on the list, as they're going to place gaining customers higher than losing customers. This was always a time filler, as scheduling goes. If a technician finished up early, or was nearby on another call, I'd schedule a pick up. But, not often as a stand alone call. The answer to your question... how long?... Never. The tank is the gas companies property. You can't scrap it, as it's hazardous. No scrap company will accept it without being cut in pieces, and, I do not recommend you try that. Call them again, remind them of the request to pick up their equipment. Squeaky wheel, you know.

This happened to me several years ago --
After 30 days I sent them a notice that 30 days from date of the registered letter (notice) they would be expected to pay a monthly rental fee. At the end of the 60th day I "caged" the two tanks and sent a bill.
THREE months later (and billed monthly) they came for their tank. I had the driver sign a receipt and sent a final bill.
Later in small claims court I won and they paid 2 days after I filed a judgement.
