oh no, tax refund problem

well I bought pellets last september and they charged me tax. Well after the great info from this forum, I wasn't supposed to get charged tax. A few weeks ago I went and showed them the receipt and they said they would take care of it. Well a few days later their main office called me asking me for my credit card number that I used to purchase the pellets. So I gave them the number. I figured they would just refund the tax amount. Well they called me said they had to refund the whole amount and then charge me the new amount. They ran into a problem where it would not let them charge the new amount.
Well that is because I have had money troubles and my card was over the credit limit with all the fees they were charging me. They said they would just wait a few days to see what happens when the credit took. Well a few days ago they called back saying to call them. I have been gone so I looked at my credit card online and sure enough the full amount that I paid was credited. I called and left them a message saying not sure why the whole amount was credited that I figured just the tax would be. I told them since I have had issues that I can not have charges on my card. So now I don't know what they are going to do or what I am supposed to do. I don't have $1200 to pay them again or to repay them.
 
Sounds like it's their problem. Let them come to you.
 
Tell them yoo'll pay them when you can, maybe pay them in installments. Its their mistake from the beginning as they shouldnt have taxed your purchase and they wouldnt be in this position.

He would own a multi million dollar house with an up to date heating system and wouldn't have to worry about $50 of tax money. :coolgrin:
 
I can almost guarantee that the store will never charge tax on pellets again! I bet if everyone on this forum sent you $1.00 you would be ok.

Don't do it. Nothing is free and at least the store tried to rectify the tax thing without a hassle. Why not call, explain the situation and try to set up a payment plan. I am sure that the dealer would prefer payments over nothing at all. In fact, the store would gain an honest customer and you would still have your dignity. I also wonder if they might be able to take you to court over this if you don't pay and that might make matters worse.
 
I called and left a message thursday about the situation but they never called back friday, so I don't know what they want to do. I said I had about 30 bags of pellets left if they wanted to come and get those back..
 
I've been charged tax on pellets too!! Every time I buy them from a certain store, they ding me. Do the same rules apply in Canada?

I hope you end up not having to pay for the pellets at all...and the store learns a valuable lesson!!
 
most likely an oversight, Im sure! Stove should know better though, and the customer should read his/her invoice.
 
Your responsibility and obligation is to pay them. It`s not their fault your credit card went sour , it`s yours .
They acted in good faith in crediting your account and assuming they could recharge the card minus the tax.
 
How about this.... Customer pays for goods received from merchant (assuming customer is happy with quality and quantity of goods received... remember customer agreed to origional price at that time or origional purchase... just the tax was incorrectly charged). Merchant having a chance to redo this transaction and make it right (without tax), should offer customer a mutially agreed upon discount on origional price to compensate customer for their time and inconvenience. This way both customer and merchant are happy and get what they want and merchant shows good faith to this customer and 'future' customers that he will always be a credible merchant and make it right. With the internet 'watching' these days, if I was a merchant and wanted to survive, i would get on fixing this real fast. IMHO.

good post, assuming the merchant still makes some money.....I think the merchant has shown good faith though. A regrettable circumstance in this economy for sure!

i second that and you need to try and make it good and not by giving them 30 bags back
 
I think you should pay, and they should understand the circumstance, and accept payments. I don't understand why they couldn't just charge back the tax, that makes no sense to me. I've run numerous cc machines and all that I've ran will let you refund portions of a purchase etc. I guess it could have been their own computer system or something though.

I don't understand that either. I am no way saying that I don't need to repay them or whatever, but they have just put me in a even worse situation Or maybe not I don't know. If they do a payment thing than that payment thing needs to be very low because if I had any extra money right now that would have been paid to my credit card and I would not be in this mess. So I don't know what I can do or they are going to do. I guess I will wait until tomorrow to see if they leave me a message or something while I am at work...
 
I dont know the specifics of your credit card situation but I wonder if you called them and explained the situation if they would allow the proper amount to be charged back to the card? It seems if they would give an inch it would save a lot of hassle for you and the folks you bought the pellets from.
 
What swallowed up the $1,200 they credited back to your account. Did you have more than that outstanding on the card?

His account is frozen. Money can come in, But nothing can go out.

Yes from experience. I boo boo-ed once too! It can happen to anyone!(well unless your Kyle Busch)

I sure hope your not actually thinking of not paying this. I agree with whoever posted that the store should cut you a break for their mistake but you need to pay them. If you don't, the rest of us will end up paying it in the end...
 
You would be better off calling them again and try to set up a payment plan. They would be stupid to let $1200 slide. I've had a collection agency call me for a 2 year old hospital co-pay of $25. They are in the right here and you are legally obligated to pay for the product you received. They will get it from you plus interest if they really want to.

so here is an update. I offered to do a payment plan. They refused. They sent me a letter stating that I either send them a check or they will have police and attornys at my door. So not sure what I should do. Any lawyers here to help..
