Damper Block Off ABOVE heatform tubes?

Dear Husband wants to use a smaller piece of steel between the damper and heatilator tubes, instead of a larger on below the tubes. We had a welder torch off 10" x 10" today to accomidate the new flex liner.

Are there problems with this?

Any feedback to help find an answer? Thanks!
 
As long as it makes a complete seal from the firebox to the chimney it should be ok. Stuff mineral wool insulation (roxul) above the plate.
