They sent out a damn fool to do the work and now they don't want to acknowledge the damages? Get it documented and have a reputable shop replace the liner and fix the baffle. Have a lawyer present them with the bill. Then take them to court.
 
WE ARE VICTORIOUS ! :p Well I dont know if I have ever wadded trough so much BS before but here is how it went down. The sweep from my stove dealer ( Good one ) said he would be more than willing to meet us at the bad sweeps business. When we arrived he had already showed up and was waiting there. We went inside to discover the bad sweep had called in sick :mad:. Larry immediately flew off his rocker and proceeded to back the manager into his office as he was attempting to say he had a previous appointment. That was worth a million bucks too. The manager said that the sweep was a new guy ( BSBSBS ALERT ). Well long story way way shorter after 2 hours of argument the owner finally shows up after being called in from vacation and was horrified by what he saw when Larry handed him the chunks of metal and the box full of baffle board! The sweep was the managers son who works part time usually with daddy ;lol His son is 31 by the way. Any way the owner pulled out a piece of paper and put his sig on it stating that he would pay for any and all damages. The owner did not care who did the install as long as it was done so he did not get sued over it. My dealer is going to come in on saturday and fix the chimney as well as the stove if he has the baffle by then. Thanks for the input guys taking the pieces was the ticket along with a good dose of well we will see you in court ! Good news Larry will have one hell of a shinny chimney now.

Right on Pete that plan was poised for perfection even in the preliminary stages!!! So glad that you reported such pertinent information when you were positioned to pounce!! :)

Thanks guys Larry did almost all of the work it was kinda like watching a soap opera ;lol Sorry Larry I know you read the forum but it was. He stood his ground like he was a news anchor dead set on standing in a hurricane. Seriously though I went for the ride and was useful simply because 2 is always better at intimidation 3 is even better. My stove dealer sweep did a lot too he kept saying you are the most unprofessional sweep and don't lie I am a sweep too I will know. Which by the way made him my new super hero ;).

Did they fire the manager's son? Wonder if that guy will be out tomorrow wrecking other chimneys. You guys just scored 1 for everyone who's ever been victimized by some turd running around and posing as a "professional". Kudos....

So glad this has turned out good....so far. It is not over with until the installer gets paid for redoing what has been undone. Had the owner not signed the paper and agreed, I'd have went straight to an attorney and not small claims court. Not sure what the limit is on small claims now but doubt it would be enough to pay for reinstalling the liner and fixing the stove. So, keep the attorney in mind just in case. As stated, it is not over with yet and won't be until the job is done tomorrow and the money is in the pocket. Good luck.

And why on earth is he cleaning the chimney so often? Also, if you just checked and it was okay, why did he call the sweep? Sounds very odd.

Good turn out in the end, Im just glad he will be burning soon snow and cold weather is here.

He was burning wet wood the beginning of last year so I cleaned it for him and got a ton of creosote. Larry fell for the firewood dealer its 2 years dry trap. The wood was soaking wet and he is new to burning. In order to be safe I cleaned it 2 more times last year and lectured him on dry wood. This year he was getting an inspection done which he insisted on. That led to the sweep saying it was not clean so the could make more money. This year he has nice dry ash and a big lesson learned too. Larry has a prosthetic leg so he cant get up on the roof to clean his chimney all that well. He said he did not want to bother me I said BOTHER ME ITS FINE <>. It was a case of he trusted the sweep because it was his job.

It's great to hear that all ended up well. Maybe get a couple electric space heaters to keep Larry warm while waiting for heat to return?

He has a fireplace on the other side of the house so they hung a blanket on the door and are attempting to stay warm but with todays wind we may have a guest.

Glad to hear it went well, and things were resolved without litigation.

For future reference, the retainer fee for a typical attorney around here is $700'ish, and I've never had one involved in my business for under $1500, which may be close to the cost of damages in this case. Then again, if you end up spending $$ either way, better to have it in your attorney's pocket than that of the guy who tried to rip you off. Developing a good relationship with an attorney now can help down the road with other small matters.
 
I have friends who do the same thing (getting things fixed after I already fixed em). You can't change it. All you can do is wait for them to get bit hard and then explain what they did wrong and hope they call you the next time they want something instead of calling a "professional".
I have had too many people take their cars to a "professional" mechanic and get hosed for $2,000+ and then come griping to me because it is worse than it was before. Then they get upset because it will take $500 and two days to get them back on the road.
Then they do it again... Hope your neighbor has learned to bother you when he needs something.

That tool should not be inserted into any liner. Only a cast iron or thick steel pipe could hold up to that beating.
 
glad it sounds like it worked out well. Also glad to hear your sweep was willing to get involved, but its good for him and his reputations.
 
A good dealer and sweep . . . kudos to them for helping . . . even helping a person who was not a customer . . . yet. I suspect they may end up with some future business even though that is not why they want to bat for the neighbor.

Well good news they installed a new liner today again I was not there to see it. I was brewing beer with my sister ;) ;ex They took a couple of hours to get the old one out and made an enormous mess because it was beat to heck after that medieval mace on a spindle went through it. Larry says it went well overall and he found a new dealer too.

Glad to hear it went well, hope the owner pays those guys now!! But hopefully that is between the 2 businesses!
