Can't fault the ladder.
 
Kinda looks like the ladder was put against the tree at a bad angle, and twisted with the weight of the fellow, throwing him off?

PS. Wearing shorts while working in a tree probably explains the lack of safety equipment...though he does have decent boots...

I bet when he hit he dusted himself off, swore at the tree, saw and ladder and then proceeded to lean his ladder right up against the next limb he was going to cut off.
