Roofing contractor keeps giving me the runaround

I signed a contract a few months back to have my roof and gutters replaced.

They came out the next month and replaced the roof. They asked for 40% down up front with the rest being due when the job is complete.

They did the roof in a day. It went well except one of the valleys is crooked and and it is clearly noticeable. I was called a couple days later and a rep from their office (let's call her "Ann") left a message asking for feedback on the job. I let her know they did a good job and politely informed her about the valley. I also sent her a pic and she agreed it should be fixed and would work on having it fixed ASAP.

A couple of days later, someone from the company (the scheduler I think) left a message in a somewhat rude tone of voice about scheduling the repair. I'll call her "Margaret". I called back 20 minutes later and was routed to the main line (secretary). I left her a message for Margaret and she did not return my call. I followed up a few days later and was told that Margaret was out of the office. I followed up again the following week after that and was told she was off that day. I left messages each time but no return call.

A week or so after that, I contacted Ann and she said she would find out from Margaret when it would be scheduled but Margaret "stepped out of the office". No follow up. I followed up the following week and had a similar response.

A week or so later (a month ago), a DIFFERENT person called to ask if the gutters were done. Apparently that job was outsourced to a subcontractor. I told her no and she said she would contact the company and work on getting it scheduled. I have not heard back.

There has been very little snow so I can't see bad weather being an excuse. That being said, I figured I'd let it go until after the holidays. I called the main office the other day and the secretary answered (really nice and polite lady) and I fill her in. She was empathetic and then brought up this "Margaret" again and said she'll let her know I called. Still no response.

I have not even heard from the billing department nor have I received a bill for the remaining amount so I assume they do not expect to be paid the remainder until the job is completed. In not one of these conversations was there any mention of money owed.

Is it unreasonable to expect some sort of communication on their end? I'd satisfied with a "we're really busy right now so it might be a month or two", but not even getting that. Not really sure what to do at this point. Should I contact the estimator who I signed the contract with initially? Is it time to figure out how to get in contact with the owner of the company? Or am I being impatient here? My concern is they will start charging interest for unpaid balance and then I get a larger bill down the line.

I am trying to figure out if I did something to upset somebody, or if they are swamped and/or just plain unorganized. I'm at the point where I'm ready to pay the cost of the roof minus the botched valley and gutters, and then find someone else do the repair and gutter replacement, but we did sign a contract.

This kind of stuff is just all too common these days...maybe even for the last 15 years or so...but its getting worse in my experience!
I run facility maintenance at work and am always amazed how much trouble I have getting quotes from people!
Most recently was a for a new large commercial door (read: expensive) I called a few places and the most local guy was the only one that was a real consideration, the next closest company didn't even respond. Unfortunately (or maybe fortunately) we are now going with a third company from out of town, due to the owner of the local place basically telling me to shove our job after I asked him, for the third time, to quote the door that I originally asked for...he quoted us everything but what I asked for, then gets mad and has a meltdown literally hours before he would have had a PO in hand if he had just done as I asked!

I would call and tell them that if they don't respond within so many days that you are going to have someone else fix/finish it up...and that you will be deducting for the "fix" portion...

I wouldn't sweat it. Right now you have a roof with an ugly valley for 40% of contracted cost. Roofing isn't a high margin industry. Right now they're looking at a big loss.

Once their receivables dept sees 60% outstanding they'll go nuts in the back office. In fact, if you want to get them moving, thats who I'd call.

It sounds like Margaret was fired or started working from home/different office.

I had one poor roofing company re-roof part of my house 3x, before it was right. First crew set first course with zero overhang, caused rain to actually spill behind existing half-round gutters. I asked the owner to have them reset 1st course with a normal 1/2" overhang past drip edge, to which he said no problem, but then the work crew came back out and the apparently-pissed off foreman had them overhang it by like 4 inches. The singles were literally laying in the gutters.

I'm sure the foreman was laughing and thinking, "you want overhang? I'll show you overhang!"

Owner of the roofing company visited my house after another call from me that night, took one look at the work, and was not amused. Fired his foreman, and sent his other crew to re-do it a third time.

I actually felt bad for the owner of the company, he definitely lost money on that job. Younger guy, trying to grow his business by having two or three crews, each with a foreman. The foreman that screwed up my job was apparently a nephew or brother in law of the owner, who the owner was trying to help by giving him a job, but apparently the guy had been trouble in the past.

does your contract give a end date? Pretty sad that they messed up the valley as that is easy to keep strait with a chock line.. I know around here getting trades to quote or do work is a nightmare. Sad part up here is their is a lot of big industry moving in and now most of the trades are saying they no longer do residential "we are the ones that kept them alive all these years". I have a friend that has been waiting for his furnace to be fixed ... we live in the north... luckily he has a wood stove to keep him warm but does nothing to keep his pipes from freezing..

agree with zrock does your contract have a end date? and if so what happens when it goes over that date. also might be worth a quick call to your lawyer to see where you stand.

I would call and tell them that if they don't respond within so many days that you are going to have someone else fix/finish it up...and that you will be deducting for the "fix" portion with this company roofing falls church va...
