Unfortunately it took soooo long to run these appointed "agencies" through the court system and put the power back into the proper branch of "elected" government, namely Congress.
 
Right. Congress endorsed the creation EPA under a Republican president, with explicit instructions to do what was best. Congress at the time knew that it can not decide major issues in a timely fashion, particularly with the fillibuster gridlock. Issues like the pandemic, for example, need an authority beyond Congress to make informed decisions quickly. The EPA has saved millions of lives and corrected many environmental disasters. It is a valued agency in dealing with climate change.

The vote was 6 to 3, along ideological lines. That the court agreed to hear the case despite the fact that the rules being challenged had been abandoned suggesting they were determined to make a point. This was a political play by the courts and a blot on our history that will have large repercussions. As noted in the dissent, “The Court appoints itself—instead of Congress or the expert agency—the decision-maker on climate policy. I cannot think of many things more frightening.”

Ironically, though they like to call themselves "originalists", they are creating new doctrines when it fits an agenda. We can not survive as a country with a politicized court. The current court is leading America into a political rabbit-hole. So is this thread, but at least here we try to stick with the ground rules and keep political discussions out. There are plenty of other places to rant about politics, but not here.
