is there a loophole in the epa law?

There is no law currently against selling un-damaged stuff (unless it is a local restriction), so I doubt that the claim of damaged is nefarious in any way. Could be that they are simply clearing out some scratch and dent stuff they accumulated.
There could very well be a local or state ordinance requiring all "new" solid fuel burning units to be EPA compliant. Selling "damaged" as is can get around that. Due to emissions laws a few years back in NY certain diesel vehicles were not able to be sold new. The dealers would put 100 miles on them which was the minimum to sell the vehicle as "used".
