Yes i agree with you begreen it is not a problem but even the fire blocks are not completely sealed which is what he is looking for and wont listen that it is not a problem
 
If there is a gap, fill it with door/glass gasket rope from the top of the ceiling box. Seals, allows expansion of the pipe.
