Richard Blumenthal has filed suit against New England Pellet of Enfield.

The AG says the company took orders from customers and cashed checks but never delivered the merchandise.

The company blames a wholesaler in New Hampshire for the unfilled orders

Guess this means that the state of Connecticut will get any money awarded in a judgement, people who paid the money will get squat. But, that's just my opinion.

Richard Blumenthal sues some business almost daily. The guy loves to see himself on T.V and in the newspapers. But even if he is glory hound looking to move up the political ladder, I hope he gets these guys to at least get the money back to the poor souls who never got their pellets. Good luck to you.

Attorney General Blumenthal has done a lot of good for our state. He doesn't do it for his political gain but to help the people of Connecticut! I only wish he had filed criminal charges against these dirt bags @ New England Pellet LLC! I'd like to see Steve on the other side of the bars and see how he likes it.

So.......If someone pays me for pellets that I say I will get for them, I not only turn a small profit off the deal but I can keep all the money and just not give them the pellets? WTF have I been doing this year and the past two years?

Someone slap me.

Can I do this with stove and pipe also?

Do they get out of everything?

Not that I am a Lawyer but if it can be proved in a court of law that you knowingly or purposely defrauded someone you can be held criminally. No matter what LLC or INC you hide behind. Just depends how good the Prosecutor and the Defense lawyer are at the case.

Eric

I am sure there will be criminal charges soon. A oil company in Maine collected money from customs in advance and locked them in at a certain price but never delivered the oil. I am pretty sure there was criminal charges, his business was shut down and all his stuff was auctioned off.

I hope these folks are able to get their money back, at the very least. I'd agree that Blumenthal prefers to fight the kind of crime that makes the evening news. Which came first, local news coverage or Blumenthal? Unfortunately, all I ever hear is his grandstanding in the beginning, when the cameras are around, and then we never hear the outcome. Podurgal Lane - Home Depot still built on a neighborhoods backyard?? Sued cigarette Co's - where the millions? Holds a press conference to announce this or that and then nothing. All show no go. Style over substance - inch wide and a mile deep, etc. I don't think that bodes well for folks getting their $$ back. Good luck though.

I don't get it....if a "wholesaler" was to blame for the lack of pellets, can someone explain where the money went? New England Pellet is blaming New England Wood pellet for failing to deliver pellets that were ordered. OK, well, who has the money? Was it paid to New England Wood Pellet who absconded with it, or in the more likely case, did New England Pellet simply take the money and run? Let's play follow the money, and I'm placing my bet that New England Pellet is the villain. New England Wood Pellet is an upstanding company and I am loathe to imagine that they contributed to this situation in any way, shape or form.

For anyone who lives in the Enfield/Suffield area, just drive by his house and you'll see where a good chunk of the money went. I hope he enjoyed his lifestyle this summer... :smirk:

Not likely that money was sitting in an escrow type account waiting for the wholesale delivery of the pellets. Chances are he used the money for whatever business or non-business related expenses he had...Rot in hell Dr. Marvin!!!!

If they had filed for Chap.11 BEFORE all the **** hit the fan, then maybe. But now, since all of the complaints have made their way to the AG, and their involved now, I don't think they can.

Im not a lawyer....but after doing some research it does seem that if the members (owners) of the LLC -- if they are the ones committing the fraud --- they cannot simply "walk away" from the business and leave the people who were defrauded "high and dry"...

Got to be kidding.
He posted this on 11/19/08 that he is looking for funding?

Doesn't he have enough money for nothing already?!

Why didn't he ask his buddy Jason for funding. Jason stated on a thread here that he had enough money to buy all the pellet mills in New England.
SCAM,,, Me thinks!

Wouldn't hurt to notify the AG's office about this.

Joined 2008-12-02 for me, this all started on april 24. i orded 5 tons of pellets in good faith with new england pellet llc. the woman i spoke with said i would get the delivery in a couple of months, the end of june by the latest. in june some friends of mine from whatley ma ordered 8 tons from rick in chicopee, a separate company under the same name except that it was new england pellet north llc. rick wouldn’t deliver that far north of chicopee so my friends asked if they could have the pellets dropped off at my place in westfield, i said that would be ok. two weeks later rick delivered my friends pellets(all 8 tons) to my place. that weekend they came and got their pellets. june came and went and i called in july, they said i should hear from them in a couple of weeks for a firm delivery date. entering august, i called again, i explained that i had to kick someone out of my garage space to make room for my pellets (losing $25 a month for a storage charge), she replied that they were alittle behind delivries because of the amount of orders that were coming in and to give them till the end of the month. once again in good faith i said ok. what a mistake. call after call all i got was a recrded message saying that all orders placed between march and may would be delivered in sept/oct. on oct 24, a friday, i was on vacation that week so i decided to call again, left amessage, not 2 minutes after this they called back(the only call i got from these people) this time i got a firm delivery date of nov.5. nov. 5 no pellets. nov. 6 called and the excuse was that their driver had to rush a family member to the emergeny room. ok that’s understandable. she said that by the end of the day or the next (friday nov. 7) i would have at least 2 tons ni my driveway. 3:00 pm friday nov. 7 my wife calls me at work, no pellets yet. now my patience is wearing thin. i call and i spoke with steve, he says the truck broke down. i tell him that his company’s communication skills are less than adequate and that they should have contacted customers and let them know. steve promised a partial delivery in the next week. i said that i hope so, seeing that i had gotten several people that i work with to order from him and they were concerned about their orders. fast forward to dec.2 no pellets, no calls, media, ct atty. gen., out a grand. sounds like fraud to me! i wonder just how warm and finacially comfortable these people are this winter. i got more call backs from rick, who i didn’t order from, than steve’s company. maybe these people should spend some time on “ice” to show them how we feel. it’s been over 7 months, 8 months on christmas eve. i’m trying to heat my home, not have a baby!(my wife and i have picked out names for each of our pallets of pellets, if you read this rick you may get another chuckle). anyway ,in closing, hopefully this will be resolved (i tend to doubt it) before the temp plummets. hope rick gets a good contract next year with a a supplier. i will order from him instead(still have his number). for the ones down in enfield, hope you guys have a 5x8 room reserved with your names on it at the state hotel! update; got in touch with atty. gen. from both ct. and ma. asked if i hired a lawyer. my reply was not yet but may do so very soon. asked what i wanted in compesation, my reply was either my 5 tons of pellets or my money back plus the difference to purchase pellets at going rate. or they could pay my gas bill for the season!
