Is this going to be safe and up to code?

I have a freestanding Osburn 2400 in the basement. I want to install the vinyl floor. It sits in a preexisting brick fireplace. Can I get away with placing some hearth pad on top of the vinyl floor, instead of building the hearth with tile?

As long as the hearth pad meets the dimensions required it will be ok. It should be 46" wide (or at least fit between the brick opening) and 42" long. However, the linked hearth pad is just an extension at 48" x 22" which is not the pad shown in the image on their webpage. That is not deep enough.

It might be easier to either leave the vinyl flooring out for the required hearth area (maybe paint the concrete?) or get a sheet of steel for a hearth pad. What is the dimension between the two raised hearth wings behind the stove?
