When I went out to visit family in San Jose, they had this gorgeous heath, but no stove. I asked them why they didn't have one and they said it was almost impossible to install a new stove if it hadn't been in the house when they bought it.

They didn't try very hard. a San Jose and several neighboring cities banned ne fireplaces and woodstoves. I got a variance to get mine installed after I flooded them with information on how much cleaner a woodstove would be versus continuing to burn in an open fireplace. In these same cities you can now add a open brick fireplace because the Masons lawyered up when he ban went into effect(claiming the ban was unfair to their trade).

Yep. I have said it here before. BB's first and only rule of dealing with bureaucrats:

At the exact moment that you make it as much work for them as they are making it for you the problem goes away.
 
Right on BB. The other thing that will get your variance passed in a heart beat is pointing out that once you (insert improvement here), the value of your home will increase by $$$$$$ thereby increasing your taxes to $$$$$. It's amazing how the next words out of their mouths are "I move that we grant MrGriz a variance for...."

Actually, I explained that I will continue to burn lots of wood in my open fireplace creating 10x the emissions, lots of smoke and sparks. I told them giving me the variance would be helping me help them become a greener city.
 
I don't think they tried too hard, this was probably about 7 years ago. They didn't have an operable fireplace to argue that point.

I hope that comes out correctly. Any one on this forum who lives in the Bay Area knows who to write to? It really sounds like they are talking about open-hearth fireplaces. It looks like even the EPA wood stoves are included.

I did some web searching and it does not look good.

I'm running a Avalon Perfect-Fit insert, love it, would never go back to an open hearth fireplace, just a waste of time.
