Do you have paperwork from the inspector saying it is not up to code? If the installer was licensed and did an install that was not up to code you could probably sue him in small claims court if he refuses to correct the install. Breaking out the clay to fit an insulated liner is not that difficult and should not take a competent installer very long to do, maybe a half days work. Possibly they could pour insulation around the current liner although I have heard mixed reviews on poured in insulation.
I do. I hope it doesn't come to that but at the cost of ~$1200+ dollars for a new liner + install I may have to pursue this if they don't correct it on their dime.
 
I'll try to have them install the correct liner at their cost when they replace my unit...who knows if they'll comply, but I hope so.
Insist. The liner install must be code compliant or your insurance protection is zip. It's not unreasonable for the installer to charge for the insulation materials.
