What kind of fly is this?

These flies are mass hatching outside of our side entrance.

I did some further research and apparently, termites are also transparent and don't normally like to be out in the open. These insects I have are swarming outside just before sunset.
 
Look like ants to me.
 
Ants are sprouting wings and flying around right now...sometimes in big quantities. Last night i saw many ants around my place and thats not normal.
 
Ants have 3 section bodies, termites 2.
I honestly can't tell by the photo.
 
i get those in the fall when it goes from cool to warm. nothing a little ant killer won't take care of. they die quick.
 
Looks like a swarming termite to me and they can be black as well as brown I think.
I usually see them swarming out of the ground from some huge cut down pine tree roots here in the early morning.
I've seen the birds trying to eat them as fast as they are trying to take off.

I see elbowed antennae, a more ant like head and what look like unequal length wings. A better closeup would show this, but I don't think they are termite which fly earlier in spring typically.
